Access to these records is restricted to authorised personnel on a need-to-know basis, in line with UK General Data Protection Regulation (UK GDPR) requirements.

2024/25 – How We Use Your Personal Information

This privacy notice is issued by the Education and Skills Funding Agency (ESFA) on behalf of the Secretary of State for the Department for Education (DfE) to inform learners about the Individualised Learner Record (ILR) and how their personal information is used.
Your personal data is used by the DfE to exercise its functions under Article 6(1)(e) of the UK GDPR and meet statutory responsibilities under the Apprenticeships, Skills, Children and Learning Act 2009.
The ILR collects data about learners and learning undertaken. Publicly funded colleges, training organisations, local authorities, and employers (FE providers) must collect and return this data annually under funding agreements, contracts, or grants. The ILR ensures public funds are allocated in line with government targets and supports education, training, employment, and wellbeing research.
ILR learner data is retained for three years for operational purposes and 66 years for research purposes. More information is available at: ILR Specification. ILR data is shared with third parties in compliance with DfE data-sharing procedures and legal allowances. The DfE and the English European Social Fund (ESF) Managing Authority (or their agents) may contact learners to conduct research and evaluation to assess training effectiveness. This is part of statutory duties and does not require additional consent.
